Terms of Service

TiFlight Platform & Services

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the TiFlight website, the TiFlight plugin for Microsoft Flight Simulator or X-Plane 11/12, and the TiFlight mobile or web application (collectively, the "Service") operated by TiFlight ("us", "we", or "our").

01. Agreement to Terms

By accessing or using the Service, registering an account, downloading our plugin, or purchasing a subscription, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. You represent that you are over the age of 18 (or the age of majority in your jurisdiction). The Service is not intended for individuals under the age of 13.

These Terms constitute a legally binding agreement between you and TiFlight (a company operating under the laws of Portugal) regarding your use of the Service.

02. Nature of Service & Disclaimers

Dependency on Supported Flight Simulators

TiFlight is an independent third-party tool. We are NOT affiliated with, endorsed by, sponsored by, or officially connected with Microsoft Corporation, Asobo Studio, Laminar Research, or any of their subsidiaries.

  • Updates: Microsoft Flight Simulator and X-Plane updates may temporarily break plugin compatibility. We are not liable for downtime caused by simulator updates.
  • Game Files: We are not responsible for any corruption of game saves, settings, "Community" folder conflicts, or hardware issues resulting from the installation of our software.
  • Flight Tracking: We do not guarantee 100% accuracy in flight tracking, fuel consumption monitoring, or landing rate calculations due to technical limitations of the simulator's SDK.

03. Plugin End-User License (EULA)

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the TiFlight Connector Plugin strictly for your personal, non-commercial use strictly in accordance with these Terms.

Restrictions

You strictly agree NOT to:

  • Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Plugin;
  • Modify, adapt, improve, enhance, translation or derivative work from the Plugin;
  • Use the Plugin to inject false data (telemetry spoofing) to gain unfair advantage in the Service;
  • Remove, alter, or obscure any proprietary notice (including any copyright notice or trademark) of TiFlight.

04. Accounts and Security

To use most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Security Responsibilities

You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities.

Account Termination

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading, or if you violate any provision of these Terms.

05. Subscriptions and Payments

5.1 Subscription Tiers

TiFlight offers different service levels, including "FREE", "PRO", and "ELITE". Specific features (such as fleet size limits, mission types, and access to lifeline missions) are tied to your active subscription tier. We reserve the right to modify the features included in each tier at any time.

5.2 Billing and Renewal

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account management dashboard or contact support.

5.3 Price Changes

TiFlight may modify Subscription fees at any time. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide reasonable prior notice to allow you to cancel if you disagree with the change.

5.4 Refunds & EU Right of Withdrawal

No Refunds: Except when required by law, paid Subscription fees are non-refundable.

Waiver of Withdrawal Right (EU/EEA/UK): If you are a consumer in the European Union, EEA, or UK, you typically have a right to withdraw from a digital contract within 14 days. However, by purchasing a TiFlight subscription and requesting immediate access to digital content (e.g., creating a Virtual Airline, accessing Pro features), you expressly acknowledge and agree that you lose your right of withdrawal once the performance of the contract has begun.

06. Virtual Economy and Goods

The Service simulates an aviation economy. This includes "AirCredits" (AC), virtual aircraft, virtual loans, leasing agreements, and company shares (collectively, "Virtual Items").

A. No Real World Value

Virtual Items are purely fictional. They have no monetary value and cannot be exchanged for real money, goods, or services. You cannot "cash out" AirCredits.

B. Not a Financial Institution

"Loans", "Stocks", and "Bank Accounts" within TiFlight are game mechanics only. TiFlight is not a bank, lender, or financial institution. No real-world debt is created or extinguished through gameplay.

C. Ownership Rights

You do not own Virtual Items. You are granted a limited, revocable, non-transferable license to use them within the Service. TiFlight retains all right, title, and interest in and to these items.

D. Economy Resets & Balancing

To ensure fair play, TiFlight reserves the absolute right to modify the virtual economy. This includes the right to wipe user data, reset balances, change prices of aircraft, or alter mission rewards at any time without liability or compensation.

07. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Cheating & Exploits: Using cheats, automation software (bots), hacks, mods, time-acceleration (sim rate > 2x), "slew mode" during missions, or any unauthorized third-party software to modify or interfere with the Service, flight data, or economy.
  • Real Money Trading (RMT): Selling, buying, or trading your Account or Virtual Items for real-world money.
  • Data Mining: Attempting to access or search the Service or download content from the Service through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like).
  • Interference: Attempting to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Service.
  • Harassment: Using the Service to harass, abuse, or harm another person or group, including in Virtual Airline chats or descriptions.

08. User Generated Content

Users may create content such as Virtual Airline names, logos, liveries, and descriptions ("User Content").

  • License to Us: By posting User Content, you grant TiFlight a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, and distribute said content on our platform for the purposes of operating the game.
  • Third-Party Rights: You represent that you own or have the necessary rights to use and authorize the use of your User Content. You agree not to use logos or trademarks of real-world airlines (e.g., Lufthansa, Delta, TAP) unless you have explicit permission or if it falls under fair use/fan art policies where applicable.
  • Liability: You are solely responsible for any copyright infringement claims arising from your User Content. We do not pre-screen all content, but we have the right (but not the obligation) to remove any User Content that we deem offensive, illegal, or in violation of these Terms.

09. Intellectual Property

The Service and its original content (excluding User Content), features, code, algorithms, and functionality are and will remain the exclusive property of TiFlight and its licensors. The Service is protected by copyright, trademark, and other laws of both Portugal and foreign countries.

"TiFlight", the TiFlight logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TiFlight or its affiliates or licensors. You must not use such marks without the prior written permission of TiFlight.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

11. Indemnification

You agree to defend, indemnify and hold harmless TiFlight and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Service, by you or any person using your account and password;
  • A breach of these Terms;
  • Content posted on the Service (User Content) that infringes on third-party rights.

12. Limitation of Liability

In no event shall TiFlight, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

To the maximum extent permitted by applicable law, TiFlight's total aggregate liability for all claims arising out of these Terms shall be limited to the amount you paid to TiFlight during the twelve (12) months immediately preceding the date of the claim.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any dispute arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Lisbon, Portugal. You hereby waive any objection to this venue based on inconvenient forum or other reasons.

14. Class Action Waiver

WHERE PERMITTED UNDER APPLICABLE LAW, YOU AND TIFLIGHT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
